特許の概要
消費者が購入条件を指定する逆オークションを行う仲介システムに関する特許である。このシステムを用いて、航空券の購入を行う場合を例として、以下に概要を示す。
①チケット購入者は、仲介サーバにアクセスして、出発地、目的地、日時などの他、希望価格を指定して、購入の申込を行う。この際、併せて、クレジットカード番号を明示する。②購入申込を受けた仲介サーバは、これを、複数のチケット販売業者に転送する。③各チケット販売業者は、この販売申込に対して販売を行う場合、受諾する旨を仲介サーバに返送する。④仲介サーバは、いずれかの販売業者から受諾の旨の返信があると、購入者のクレジットカード番号を用いて、チケット購入の決済を行う。
上記のように、このシステムは、ユーザが価格を指定して、複数の販売者に提示するという、購入者主導のオークションである点に特徴がある。また、仲介サーバは、クレジットカード番号を予め得ておき、販売業者からの受諾があれば、直ちに決済を行うようにして、ユーザによる「ひやかし」を防止している点にも特徴がある。
事件の概要
本件特許は、Buyer-driven、Reverse auction、Neme Your Own Price などのキーワードとともに報道されている。
Wallker Digital社は、本件特許のシステムを、priceline.comという会社を設立して実現し、短期間で店頭公開したことから話題を呼んだ。発明者のWallker氏は、この他、多くのビジネスモデル特許を出願ないし取得していると伝えられている。priceline.comのウエブでは、航空券のチケットのほか、車やホテルの予約等も行っている。
マイクロソフトの関連会社であるExpedia.comも、チケット販売等の仲介を行っているが、１９９９年１０月になって、Wallker Digital社から特許権侵害であるとして訴えられている。
また、本件特許に対し、MarcExchange社は、インターフェアレンス手続を行ったと伝えられている。また、MarcExchange社は、同社の有するUSP5,845,265が、プライスライン特許の基本特許にあたると主張している。
Wallker Digital社は、'96ごろに、関連特許を２５件程度出願していると伝えられており、'99.12月に入って、上記の３つの特許に加えて、２つの特許を取得したと発表している。続いて、同月さらに１つの特許を取得したと発表した。さらに、２０００年１月には、７件目の特許を取得したと発表している。
さらに、関連特許が、２０００年７月４日に許可され、そのわずか１０日後の７月１４日に、priceline.comは、当該関連特許に基づいてマイクロソフトを提訴した。詳細は、(26)購入申込の管理システムの特許（ＣＰＯ特許）を参照
2001年１月９日、Expedia.comがロイヤリティを支払うことで和解した。

and at least one of sellers, comprising:
inputting into the computer a conditional purchase offer which includes
an offer price;
inputting into the computer a payment identifier specifying a credit card
account, the payment identifier being associated with the conditional purchase
offer;
outputting the conditional purchase offer to the plurality of sellers after
receiving the payment identifier;
inputting into the computer an acceptance from a seller, the acceptance
being responsive to the conditional purchase offer; and
providing a payment to the seller by using the payment identifier.

23. A method for using a computer to facilitate a transaction between a
buyer and at least one of a plurality of sellers, comprising:
inputting into the computer a conditional purchase offer which includes
an offer price;
inputting into the computer a payment identifier specifying a financial
account, the payment identifier being associated with the conditional purchase
offer;
outputting to the buyer a request for authorization to use the payment identifier
to provide a payment it an acceptance is received;
inputting into the computer authorization from the buyer in response to
the request;
outputting the conditional purchase offer to the plurality of sellers after
receiving the payment identifier;
inputting into the computer an acceptance from a seller, the acceptance
being responsive to the conditional purchase offer; and
providing the payment to the seller by using the payment identifier.

viewing, using a computer, special fare listing information for air travel
to a specified destination location from a specified departure location
within a specified time range, said special fare listing information excluding
a specified departure time;
transmitting, using a computer, a request to purchase a commitment for carriage
corresponding to said special fare listing information;
receiving a commitment for carriage, including an obligation by an airline
to provide a seat on a flight, that satisfies said request but does not
specify a departure time;
accepting said commitment for carriage; and
receiving at a time subsequent to said accepting an identification of said
departure time.

1. A data processing apparatus for determining a price of an option to purchase
an airline ticket, comprising:
a central controller including a CPU and a memory operatively connected
to said CPU;
at least one terminal, adapted for communicating with said central controller,
for transmitting to said central controller option pricing information including
departure location criteria, destination location criteria, and travel criteria;
said memory in said central controller containing a program, adapted to
be executed by said CPU, for calculating a price of an option to purchase
within a future period, for a particular ticket price, an airline ticket
satisfying the departure location criteria, destination location criteria,
and travel criteria;
wherein said central controller receives said criteria from said terminal
and calculates the option price based upon the criteria.
